The absolute most annoying thing about owning a phone is receiving calls from telemarketers. And even if you’re on the “Do Not Call” list, some very aggressive companies seem to have found a way around it.
Robo calls can be especially annoying since you’re not even speaking with a real person. But if you’ve received “You just won a free cruise!” robocall in the past then you could have some cash coming your way.
Details of the Case
Resort Marketing Group made automated phone calls on behalf of Carnival Cruise Line, Norwegian Cruise Line, and Royal Caribbean International. These calls, which were made between July 2009 and March 2014, violated the Telephone Consumer Protection Act (TCPA).
The TCPA protects us from receiving automated or pre-recorded calls unless we have given written consent to be contacted that way. Resort Marketing Group claims that individuals gave consent by visiting certain websites. However, the company that sold contact information to Resort Marketing Group said they purchased that information from a data broker.
This class action suit was filed in 2012. A federal judge recently gave preliminary approval for the settlement. Resort Marketing Group, Carnival Cruise Line, Norwegian Cruise Line, and Royal Caribbean International will set up a fund of between $7 million and $12.5 million to pay the people who received the robocalls.
Find out if you are a part of the settlement
If you’re a part of this settlement then you should have received a notice with a claim number. If you haven’t received a notice but you believe you received a robocall from one of those cruise lines within the specified time period then you can check this website. You’ll type in your phone number and the site will run it through a database.
If you have an eligible phone number then you will receive up to $300 for each robocall you received. However, the limit is three calls per phone number so the most you can receive is $900. You must file a claim, either through an online form or by mailing in a form, in order to receive the money. You have until November 3, 2017, to file the claim.
